- First requirement for patent application is that you must search for patents that already exist as you cannot get a patent for existing products.
- You must ensure that your product follows the general criteria used in India. India grants patents for something that comes under natural law. The product must be new and something that a common person is unable to think of.
- For online application, register for a new account on websites of government of India. Once you have the account, log on to the website and select “eFilling of Patent Application” available on left side of your computer screen. You will be directed to another website where you can client software for application process.
- Fill complete details in the application form and save it in xml format using the downloaded software. Sign the completed application form and upload it on the website. The steps for payment of patent fee are mentioned in the file. Follow the steps-by-step instructions to complete the process.
- After uploading the completed file, ensure that everything was uploaded properly. Once your packaged file is accepted online, you get an online acknowledgement paper. Take a print of acknowledgement.
- You must log on to your account regularly to know the status of your application as there is no email sent for grating of patent. The status of registered patents or approval is available on the website itself.
